1. About these terms
These terms govern your use of megnity.com (the “Site”), operated by BNB Tech Source Inc (doing business as Megnity Technologies), 6909 W Ray Rd #15-143, Chandler, AZ 85226, USA, together with Megnity Technologies Pvt Ltd, Purva Summit, 2nd Floor, Whitefield Road, HITEC City, Hyderabad, Telangana 500081, India (“Megnity”, “we”, “us”).
By using the Site you agree to these terms. If you do not agree, please do not use it. Our handling of personal data is described in our Privacy Policy, which forms part of these terms.
2. Our services are covered by separate agreements
The Site describes our consulting, implementation, data and AI services. Nothing on it is an offer, quotation or contract. We provide services only under a written agreement signed by Megnity and the client. If that agreement conflicts with these terms, the agreement takes precedence for the services it covers.
3. Using the Site
You may use the Site for lawful business and informational purposes. You agree not to:
- break the law or infringe anyone’s rights through your use of the Site;
- attempt to gain unauthorised access to the Site, our servers or related systems, or probe, scan or test their security without our written permission;
- interfere with the Site, including by overloading it, introducing malware or sending automated or bulk requests;
- scrape, harvest or copy Site content at scale, or use it to train a machine-learning model, without our written permission;
- submit false, misleading or abusive information through our forms, or use them to send spam or unsolicited promotions;
- impersonate any person or organisation, or misrepresent your affiliation with Megnity.
We may suspend or restrict access to the Site at any time, including to protect its security.
4. Our content and intellectual property
The Site, its text, designs, graphics, logos, illustrations, case studies, articles and code are owned by or licensed to Megnity and protected by copyright, trademark and other laws. Some images are used under licences from third-party providers.
You may view the Site, and download or print single pages for your own internal business use, provided you keep copyright notices intact. You may quote short extracts with attribution and a link to the source page. Any other use, including republishing, selling, adapting or distributing our content, needs our written permission.
“Megnity” and our logo are our trademarks. You may not use them without our permission.
5. Third-party names and trademarks
Salesforce, Agentforce, Data Cloud, MuleSoft, Tableau, Databricks, Claude, Anthropic, Google, LinkedIn, X and YouTube are trademarks or registered trademarks of their respective owners. Their use on the Site identifies the platforms and tools we work with. It does not imply sponsorship or endorsement by those owners, except where we state a specific partner status. Megnity is independent of these companies.
6. Information, not advice
Content on the Site is general information about our services and about technology and Life Sciences topics. It is not legal, regulatory, compliance, medical, financial or professional advice, and it is not a substitute for advice on your specific situation.
In particular, the Site does not tell you how to validate a system, meet GxP, FDA, EMA or other regulatory requirements, or protect patient or personal data. Those depend on your specific circumstances, intended use and risk assessment. Case studies and accelerators describe past work or starting points; results depend on each client’s circumstances and are not guaranteed.
We try to keep the Site accurate and current, but we make no promise that it is complete, up to date or free of errors. Features, partner programmes and third-party product names change.
7. Contact forms, enquiries and subscriptions
When you send an enquiry or subscribe, you confirm that the information you give is accurate and that you are allowed to share it. Sending an enquiry does not create any client relationship, confidentiality duty or agreement to provide services. Please do not send confidential, regulated or sensitive information (such as patient or health data, or trade secrets) through the Site’s forms.
You can unsubscribe from our emails at any time using the link in them or by emailing info@megnity.com.
8. Ideas and feedback
If you send us feedback, suggestions or ideas about the Site or our services, we may use them without obligation to you, subject to our obligations under the Privacy Policy and applicable law.
9. Links and embedded content
The Site links to and embeds content from third parties (for example, social media and YouTube). We do not control these and are not responsible for their content, availability, security or privacy practices. Using them is at your own risk and subject to their terms. Linking to the Site is welcome if it is not misleading and does not suggest endorsement, and we may ask you to remove a link.
10. Accessibility features
The Site offers features such as a read-aloud tool that uses your browser’s speech engine. They are provided as a convenience and may not work on every device or browser. If you have trouble accessing any content, contact us at info@megnity.com and we will try to provide it another way.
11. Availability
We provide the Site “as is” and “as available”. We do not guarantee that it will be uninterrupted, secure or error-free, and we may change, suspend or discontinue any part of it at any time without notice.
12. Disclaimer of warranties
To the fullest extent the law allows, we disclaim all warranties, express or implied, in relation to the Site and its content, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the fullest extent the law allows:
- Megnity and its directors, employees and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of, or inability to use, the Site; and
- our total liability for any claim relating to the Site is limited to US$100.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be excluded.
14. Your local rights
If you are a consumer or located in the European Union, the United Kingdom or another place with mandatory local laws, these terms do not take away rights you cannot waive under those laws.
15. Indemnity
You agree to compensate us for losses, claims and costs, including reasonable legal fees, that arise from your breach of these terms or your unlawful use of the Site, to the extent the law allows.
16. Governing law and disputes
These terms and any dispute about the Site are governed by the laws of the State of Arizona, USA, excluding its conflict-of-law rules. The courts of Maricopa County, Arizona have exclusive jurisdiction, except where your local mandatory law gives you the right to bring a claim in your home courts. Before starting formal proceedings, please contact us at info@megnity.com so we can try to resolve the matter informally.
17. Changes to these terms
We may update these terms from time to time. The updated version applies from the “last updated” date shown. If you keep using the Site after that, you accept the changes. Please review the terms regularly.
18. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these terms; we may assign them to an affiliate or successor. These terms, with the Privacy Policy, are the entire agreement between you and us about the Site.
